GENERAL CONDITIONS OF SALE
Art. 1 – Acceptance of the general conditions of sale and conclusion of the contract
The contract stipulated between Maplast (hereinafter “skiroad.it”) and the Customer (i.e. the subject, natural person, who makes the purchase on the Site, not attributable to their commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even partial, of the order by skiroad.it. In the event of non-acceptance of the order, skiroad.it will in any case provide timely communication to the Customer.
By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these general conditions (hereinafter the “Conditions”).
These Conditions can be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
Art. 2 – Purchase Methods
The products offered for sale by skiroad.it are only those present on the skiroad.it Site at the time the Order is placed, as described in the relevant information sheets.
In any case, it is understood that the images accompanying the descriptive sheet of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the Site and view the images).
To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after carefully reading the Conditions, as well as the characteristics of the product and/or products that he/she intends to purchase. The Customer must also request skiroad.it to issue a tax invoice relating to the purchase, pursuant to art. 22 of Presidential Decree no. 633/1972.
Correct receipt of the Order is confirmed by skiroad.it by means of an e-mail response, sent to the e-mail address provided by the Customer. This confirmation message will briefly report the conditions of purchase, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate without delay the necessary corrections of incorrect data.
Art. 3 – Prices and Payment Methods
The prices indicated on the Site are to be considered inclusive of taxes and in particular VAT. Any shipping costs or payment charges are in any case communicated in advance to the Customer through the Site or these Conditions.

For payment, the customer can use the Paypal circuit according to the specific methods of the same
Credit Card
In the case of purchasing goods with the Credit Card payment method, the transaction can take place through the secure server of the payment gateway chosen by skiroad.it. In no case and at no stage of the payment will skiroad.it be able to know the information relating to the Customer’s credit card, transmitted via a protected connection directly to the Site of the banking institution that manages the transaction. No computer archive of skiroad.it will store such data and therefore in no case skiroad.it can be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment
Art. 4 – Delivery of products and related costs
The products purchased will be delivered to the address indicated by the Customer in the Order within the terms indicated on the Site from the acceptance of the Order by skiroad.it at the cost specifically indicated on the Site before sending the Order. When activated, skiroad.it reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may be subject to change.
With regard to deliveries requested in countries outside the European Union, any import customs costs will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of his/her country in advance to verify the costs and any import limits.
The delivery times indicated by skiroad.it must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.
Upon delivery of the products, the Customer is required to check:
that the number of packages delivered corresponds to that indicated in the accompanying document
that the packaging is intact, not damaged, nor wet or in any way altered, even in the closing materials (adhesive tape or metal straps).
Any damage to the packaging and/or the product or the discrepancy in the number of packages or the indications must be immediately reported by making a specific indication on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.
Art. 5 – Right of withdrawal
Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.
To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send skiroad.it a communication to this effect, within the terms indicated, to the following email address info@skiroad.it .
In the event of withdrawal, the Customer must return the product within 14 (fourteen) days of the withdrawal itself, to the following address:

The return is managed by the customer who can choose the return method, bearing the costs.
The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and boxes), stored and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being any signs of wear or dirt, in compliance with the conditions set out below:
– the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, complements, etc.); for withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, seals, etc.);
the shipment, up to the certificate of receipt in the warehouse indicated by skiroad.it is under the complete responsibility of the customer;
– in the event of damage to the goods during transport, skiroad.it will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relevant refund; the product will then be made available to the Customer, simultaneously canceling the request for withdrawal;
-skiroad.it will not be liable in any way for damage, theft, loss that occurs during or in any case in connection with the return shipment.
Skiroad.it will refund the Customer the entire amount already paid, within 14 (fourteen) days of withdrawal, through a reversal procedure of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. skiroad.it may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly returned the product, if earlier.
In any case, the Customer will lose the right to withdraw in cases where skiroad.it finds that:
– the returned product and/or its accessories, and/or its packaging are not intact;
– the product is missing its external packaging and/or the original internal packaging;
– the product is missing integral elements and/or accessories (e.g. laces, patches, etc.).
In the event of forfeiture of the right of withdrawal, skiroad.it may decide whether to return the purchased product to the sender, charging the latter the shipping costs, or to refund the customer an amount lower than the value of the intact product, deducting the value of the damage and the costs necessary for reconditioning and the product itself.
Art. 6 – Guarantees
All products sold by Maplast are covered by a 24 (twenty-four) month guarantee for defects of conformity, pursuant to Title III of Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.
The guarantee for lack of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and with the provisions of the instructions for use and maintenance downloadable from the website www.skiroad.it.
In the event that, for any reason, skiroad.it is not able to return to the Customer a product under guarantee (repaired or replaced), or if the repair or replacement were, also due to the value of the product, excessively expensive, skiroad.it may proceed with the appropriate reduction of the price paid, or the refund of the entire amount paid with termination of the contract.
In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

Art. 8 – Privacy
The personal data collected by placing the Order will be processed by skiroad.it for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and subsequent amendments to the privacy policy on the Site. Any further processing will be carried out only with the express consent of the Customer.
Art. 9 – Applicable law
The sales contract referred to in these Conditions and its execution are governed by Italian law, with the non-application of the conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. The Court of Macerata will have jurisdiction over the resolution of any related disputes.
Art. 10 – Copyright
Trademarks, logos and other distinctive signs present on the Site belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited. The contents of the Site are protected by copyright (texts, images and graphics).
Art. 11 – Agreement
The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject of the contract, together with the order, the general conditions relating to the use of the Site and the conditions relating to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.
Art. 12 – Communications
All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. Communications sent to the email address of the other party, indicated on the Site and in the order, are also considered to be sent in writing.
Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgement of receipt.
Art. 13 – Language
The sales contract is drawn up in two versions: Italian and English. In the event of discrepancies in the translation, the Italian version will prevail.
